Parents Receive $1.75M For Wrongful Death Of 21-Year Old Son
On March 21, 2005 Justin Mendoza left a nightclub in San Francisco called Club Cocomo. Shortly after, he was murdered and today, the club, the company the club hired to do security and the owner of the building have been ordered to pay Mendoza's parents $1.75 million for the wrongful death of their son. Mendoza, a 21-year old San Francisco International Airport employee, was fatally shot outside the club following a popular and crowded hip-hop music event.
He died in the arms of a friend who had rushed over to help him.
The substantial settlement amount to be paid by Club Cocomo and the other defendants to Eduardo and Denise Mendoza of Daly City was signed by a San Francisco Superior Court Judge today.
The personal injury attorneys acting on behalf of the Mendoza's made it perfectly clear that their son's death could have been avoided, hence a wrongful death, and compelled the court to hold the negligent parties responsible for the physical loss and emotional pains they have and will continue to suffer due to their son's death. The wrongful death lawsuit claimed that 100's of club goers flooded the streets after the event and that the club and its security force failed to supervise the crowds or halt the violence that ensued. When an altercation occured between two groups unaffiliated with Mendoza, a shot was fired that struck and killed the 21-year old. The assailant, a 28-year old, wounded others and has since been convicted of the murder of Mendoza, three counts of attempted murder and two counts of assault with a firearm. He was sentenced to 74 years to life in prison.
The settlement includes a $1 million from Club Cocomo; $500,000 from the security firm and $249,999 from the landlord.
